The individual employment agreement is an indispensable and obligatory legal document, which contains the terms and conditions of employment as agreed between the employer and the employee.

Individual employment agreement for a fixed term

This is an exception to the general employment stability rule, which is only used when aligned with the nature of the job, or when there is a temporary substitution of an employee (temporary disability), which should be fully justified.

Individual employment agreement for an indefinite term

This is the type of agreement which formalizes the employment agreement (and is assumed to be the applicable type of agreement, in the absence of a written employment contract).

Individual employment trainee contract

This agreement is initially limited to three months, and is intended to allow the employee to acquire the skills necessary for the job to be executed. The term could be extended to six months for individuals who need to train for the performance of managerial or directive services, or when the job requires specialized professional training. During the training term, the employee is entitled to the full salary, benefits and social security coverage that applies to the permanent position.

Trial period employment agreement

In general, a trial period employment contract is limited to 30 days in general, but could exceptionally be for to to 180 days, in the case of top level officers and/or specialized professional or technical personnel of the company. During this temporary employment, the individual is entitled to full compensation, benefits and social security coverage, as applicable to indefinite term employees. Temporary employment contracts are not extendable.
